Functions of CID

The Crime Branch, Crime Investigation Department (CB-CID) is amongst the most important units of the police organization. The Crime Branch is primarily and chiefly concerned with matters pertaining to crime, investigation, prosecution and collection of criminal intelligence, whereas, the State Special Branch is primarily concerned with the collection, collation and dissemination of intelligence on and about various political, communal, terrorist, labour activities and with relation to various law and order issues like agitations, strikes, demonstrations etc..

Also Page 223 Chapter 15 of the Bihar/Jharkhand police manual in its section 410 and subsequent thereof clearly states the functions of the department as:

Sec 409. Controlling Officers.—(a) The Criminal investigation Department is under the control of an officer of an officer generally not below the rank of a Deputy Inspector- General of police. Similarly, the Intelligence Department is under the control of another Deputy Inspector- General.
(b) For posting of Superintendents of police who will be separately Incharge of different wings in the two departments, see rule 7A (i) (b) and (c). Other subordinate police officer will be posted in the two departments (for field operation also).

(c) Ministerial Officers.—While assistants are employed in Criminal Investigation Department, ministerial officers with executive ranks shall be posted in Intelligence Department who will form a cadre of their own and shall be appointed under police Act (5, 1861)

(d) Both the departments shall be manned by personnel of transfer from the general cadre and thus there will be no direct recruitment. Apart from this, in the Intelligence Department, officers called “Reporters” shall he taken from the cadre of Steno Assistant Sub Inspectors and Steno Sub-inspectors.

(e) The employees of the two departments shall be deputed, transferred, promoted, etc., like employees of police ranges according to rules given in chapters like 23, 24 and Appendix 72 etc.

(f) For restrictions of use of Police uniform and in giving police salute for Criminal Investigation Department/Intelligence Department officials see rule 1061 (e)

410. Function of the departments—(1) Separate orders are laid down in a special manual for function of the Intelligence Department.

(2) The functions of the Criminal Investigation Department shall specially include the following: ---
(a) The collection of distribution of information relating to professional cases and classes of crime detailed below: ---
(1) dacoity;

(2) highway, railway or mail robbery;

(3) counterfeiting coin or stamps, forging notes, uttering of being in possession of counterfiet coins or stamps or forged notes;

(4) drugging of poisoning by professional poisoners;

(5) Swindling;

(6) action against criminal gangs such as cases, under section 400 and 401, IPC and proceedings under sections 109 and 110, Cr.P.C.

(7) professional criminals whose operations extend beyond the limits of a single districts;

(8) Such crimes about whom Inspector-General gives special orders.

(b)(i) To control, advise of assists as circumstances require, in enquiries or investigations into crime of the classed described in (a) above.

(ii) To control, advise of assist in investigations into other serious crime in which such control, advise or assistance is invoked by the local authorities with the approval of Inspector-General or ordered by the Inspector-General or Government.

(iii) To enquire about the movements of foreign criminals and about such matters in which local police asks for help.

(c) To make enquiries concerning forgery of telegraphic of railway receipts, postal frauds, the movements of foreign criminals and the like, in which the assistance of the department may be similarly invokes or directed.

(d) Specialised squads shall be set up at headquarters for investigation of cases. Employees posted in every squad shall investigate cases connected with squads and in case of necessity, shall be sent of deputation for this work throughout the State, The squads shall be of following types:--

Cheating and defalcation squad.

Forged note and counterfeiting squad.

Murder squad.

Railway Crime squad (see Rule 680)

Eve teasing prevention squad





Apart from this, there shall be other branches in offices for special works

(e) In the headquarters of Criminal Investigation Department, there shall also be statistical section museum (Rule 1386), library, record and law sections, the incharge of these sections should be experts and an annual stock verification of books, records and items in the museum must be done.

(f) The following offices shall also be attached to this department:--

Finger Print Bureau (Chapter 16),

Laboratory ( Appendix 25),

Photo Bureau ( Appendix 22),

Dog Squad ( Appendix 83) whose braches can be set up in other districts also,

Missing Persons Bureau ( Appendix 81), and

Juvenile Aid Bureau ( Appendix 82)





Similarly, the work for scientific examination shall be done in State Forensic Science Laboratory (Chapter 42)

(g) Criminal Investigation Department to keep in contact with Inter-national Crime Police Orgnisation:--Instructions regarding collecting and disseminating information about crimes and criminals with an international complexion, their Finger Print slips, photographs etc, are given in Appendix 95.

(h) Whenever a foreigner is to be released from any jail in the State, information about the date of release and the place of release should be passed on to the Criminal Investigation Department for onward transmission to the Interpol Division of the C.B.I. So that, the foreigner may not escape vigilance.

 

Apart from this due to increase in the complexity of crime and working conditions few other functions of the crime investigation department are as follows:-

  1. Registration, investigation, detection and prosecution of specified class of cases and cases entrusted by the Government and DGP.
  2. Conducting of enquiries as per laid down procedure in prescribed situations.
  3. Maintenance, up-dating and use of Crime-Criminal Information System, crime and criminal records, planning and implementation of criminal intelligence system and crime analysis to improve prevention, detection, investigation and prosecution of criminal cases.
  4. Coordination of investigation and related matters in the State and with other States and National Institutions/Organizations dealing with crime investigation and maintenance of crime & criminal records.
  5. Efficient, professional and independent functioning of SCRB, FPB and their modernization.
  6. Advise, assist and report to DGP and Government on matters concerning investigation and prosecution.
  7. Timely submission of returns and reports to the concerned Central & State Govt. agencies.
  8. Reply to Parliamentary & Assembly questions on crime and other matters relating to the State Police department except those that relate to purely administrative issues.
  9. In cases relating to Human trafficking launch rescue operations and attend to post rescue victim care and protection in coordination with the NGOs.
  10. Maintain Data base in r/o cases under trial, court disposals and court orders.
  11. Examine and report on judgments for filing appeals.
  12. Examine and report on references relating to criminal law and legal matters.
  13. Support presentation of prosecution evidence in important cases by way of research work and coordination with I/Os.
  14. Issue of Identity Cards to the Police personnel by the photography cell.
  15. Maintain dog squad and assist through their services the district and Special Branch in tracking of criminals, checking of narcotics and explosives and anti sabotage checks.
  16. CB-CID will assist and support the district police either by taking up the entire investigation of a case, or by sending one or more of the specialist investigating officers or civilian experts to the district Police, including visits to scenes of crime, providing technical support, criminal intelligence and information, crime analysis and providing specific advice on investigation or coordination within the state and other states, securing investigative assistance from other states and countries.
